California has enacted a remote online notarization framework, but California notaries cannot perform RON yet. Under current California law, a signer must physically appear before a California notary for acknowledgments, jurats, and other notarial acts that require personal appearance. A live video image is not currently treated as personal appearance for a California notary.

Senate Bill 696 created California’s Online Notarization Act and is being implemented in stages. The remaining provisions that authorize California notaries to perform online notarizations become operative when the California Secretary of State certifies completion of the required technology project, or January 1, 2030, whichever occurs first, subject to the statute’s implementation provisions.

California law also recognizes certain notarial acts performed under the authority of another state or jurisdiction. Whether a remotely notarized document is appropriate for your transaction—and whether the receiving court, bank, title company, agency, or other recipient will accept it—should be confirmed before scheduling.

FAQS

What is Remote Online Notarization (RON) in California? +
Remote Online Notarization is a notarial process performed through secure audio-video technology rather than physical face-to-face appearance. California has enacted a future RON framework, but California notaries are not yet authorized to perform RON under the provisions that have not become operative.
Is remote online notarization legal in California? +
California enacted Senate Bill 696, the Online Notarization Act, but the provisions allowing California notaries to perform RON are not yet operative. Current California law still requires physical appearance before a California notary for notarial acts such as acknowledgments and jurats.
Can a California notary perform remote online notarizations right now? +
No. The California Secretary of State states that California notaries cannot currently perform remote online notarizations using audio-video communication. The signer must physically appear before the California notary under current law.
What did California Senate Bill 696 change? +
Senate Bill 696 created California's Online Notarization Act, established a future registration and platform framework for online notaries, and addressed recognition of certain notarial acts performed under the authority of other states or jurisdictions. The law becomes operative in stages.
When will California notaries be able to perform RON? +
The remaining provisions authorizing California notaries to perform online notarizations become operative when the California Secretary of State certifies completion of the required technology project, or January 1, 2030, whichever occurs first, subject to the statute's implementation provisions.
Do California notarizations currently require physical appearance? +
Yes. For notarial acts requiring personal appearance, current California law requires the signer to be physically present before the California notary. A video image or other non-physical appearance does not currently satisfy that requirement for a California notary.
Can a California resident use an online notary commissioned in another state? +
In some circumstances, a California resident may use a remote notary acting under the authority of another state or jurisdiction. The notary must act within the authority of that commissioning jurisdiction, and the document and receiving party must permit or accept that form of notarization.
Will California recognize a document remotely notarized under another state's laws? +
California law gives effect to certain notarial acts performed under the authority of another state or jurisdiction when statutory conditions are satisfied. Acceptance for a specific filing, transaction, court, lender, title company, or other recipient should still be confirmed in advance.
What identification is required for a remote online notarization? +
Identification requirements depend on the law of the notary's commissioning jurisdiction and the online notarization platform. Remote sessions commonly use government-issued identification plus technology-based identity verification, but the exact method must comply with the governing jurisdiction.
Are remote online notarization sessions recorded? +
Recording requirements depend on the law governing the remote notary and the platform being used. Many RON jurisdictions require an audio-video recording and electronic journal record, but the applicable commissioning-state rules control.
What types of documents may be suitable for remote online notarization? +
Eligibility depends on the document, the law governing the notary, and the receiving party. Some affidavits, authorizations, business documents, and other records may be candidates, while estate-planning, real-estate, court, witness, or recording matters can have additional restrictions or acceptance requirements.
How do I determine whether remote notarization is appropriate for my document in Los Angeles CA 90045? +
Send the document for review and confirm the receiving party's requirements before scheduling. We can help identify whether an authorized remote-notary option may fit the transaction or whether an in-person California notarization is the safer route.
